Finally Court Tested Dvds

The legality of many copyright, rights management, and fair use backups of DVDs is kind of up in the air. Many of these almost conflicting laws haven't ever been tested in court.

In the United States for media, generally there is the fair use doctrine. This means that an individual in most cases can take a form of purchased media and make some form of backup as a copy in case the original is no longer working. At the same time with most DVDs, companies have put DRM on them making it so that it's difficult to backup.

Once people found out how to backup and get around the DRM which is an encrypted way of keeping people from making a copy, the laws were changed to say that you can legally make a copy but it's illegal to break the encryption. This means that you can but you can't.

Danish is very similar. Recently, one man copied 100 of his personal DVDs to his media center computer so that he could watch his movies and his content as he wished. Because the laws are so fuzzy and unclear, this man turned himself in saying that he illegally broke the DRM 100 times for copying his 100 DVDs. The idea is to actually get a ruling on this process. Since this is Danish it doesn't effect US law, but it still interesting to see how a court might handle these contradictory laws. Does the consumer's right to a backup outweigh the company's DRM?

The interpretation of international courts could effect the contradictory local US laws.
